一、美国商标注册有效期

1. 注册证首次核准后有效期为 10 年，自注册日起算。
2. 在第 5—6 年之间，权利人必须提交“续用或不可撤销声明”（Section 8 Declaration of Use/Excusable Non-use）。未提交或被驳回将导致商标被撤销。
3. 在第 9—10 年之间，需提交“续展申请＋续用声明”（Combined Section 8 & 9 Renewal）。以后每隔 10 年均须按此节奏重复续展。
4. 每个法定期限届满后均可享有 6 个月宽限期，但须缴纳宽限期附加费用。
5. 只要按期提交上述文件并保持实际商业使用，美国商标可无限期续存。

1.Initial TermA U.S. trademark registration is valid for ten (10) years from the registration date.
2.Maintenance Between Years 5 and 6The registrant must file a Section 8 Declaration of Use (or Excusable Non-use). Failure to file, or a refused filing, will result in cancellation of the registration.
3.Renewal Every 10 YearsBetween the 9th and 10th years—and every ten years thereafter—the owner must file a combined Section 8 & 9 (Declaration of Use + Renewal).
4.Grace PeriodA six-month grace period is available after each deadline, subject to additional fees.
5.Unlimited ProtectionProvided that all required maintenance and renewal filings are made and the mark remains in bona fide commercial use, the registration can remain in force indefinitely.
Example Timeline• Year 0: Registration issued• Years 5-6: File Section 8• Years 9-10: File Combined Section 8 & 9• Years 19-20, 29-30, etc.: Repeat the same combined filing every decade
